Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") form a binding agreement between you and Awale Hussein, an individual based in Ontario, Canada, operating as "Facely" ("Facely", "we", "us") governing your use of the Facely mobile application and any related services (together, the "Service").

By downloading, opening or using Facely, you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.

2. Eligibility and age

You must be at least 13 years old to use Facely. If you are under the age of majority where you live, you may use the Service only with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use.

Because Facely rates physical appearance, we do not consider it appropriate for younger teenagers, and the App Store age rating reflects that. You also confirm that you are not barred from using the Service under the laws of your country.

3. Your account

Facely creates an anonymous account for you automatically. There is no username, password, email address or sign-in screen. This has consequences you should understand before you rely on the app:

• Your account is tied to this installation on this device.
• Signing out is permanent and irreversible. There is no way to sign back in. Signing out clears your data from the device and starts you again as a new user.
• Deleting the app, resetting your device, or losing it, loses your history. Your scan photos live only on your device and cannot be restored by us.
• Your account does not transfer between devices.

You are responsible for securing your device. Anyone who can unlock it can see your Facely data.

4. Licence to use Facely

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use one copy of the Facely app on Apple-branded devices that you own or control, for your own personal, non-commercial use, in accordance with these Terms and the App Store Terms of Service. We reserve all rights not expressly granted.

5. Scores, AI output and what they mean

Facely's scores, sub-scores, written rationales, suggested tasks and Coach replies are produced by artificial intelligence models analysing the photos and information you provide. You must understand and accept the following before relying on anything the Service tells you.

• A score is an opinion, not a measurement. Attractiveness is subjective, culturally variable and not objectively quantifiable. A number produced by a model is an estimate of how a trained system judges a photograph — not a fact about your face, your value, your desirability or your worth as a person.
• Output can be wrong. AI models make mistakes. Scores and written rationales may be inaccurate, inconsistent, poorly calibrated, or may describe features that are not actually present.
• Photographs, not faces, are what get scored. Lighting, camera lens, angle, distance, expression and image quality materially affect the result. Two scans taken minutes apart in different conditions can differ.
• Scores are adjusted for presentation. The number shown to you is not a raw model output. We apply a consistent adjustment before display, so scores should be read as relative to other Facely scores, never as a percentile, ranking or comparison against any real population.
• Results are not comparable across apps or versions. We may change our models, prompts or scoring approach at any time, which can shift how the same photo scores.
• The AI Coach is a limited assistant. It is scoped to your own scan and routine and will decline unrelated topics. It is not a professional, a therapist or a human, and its answers should not be treated as expert guidance.

You use AI output at your own discretion and risk, and you are solely responsible for any decision you make on the basis of it.

6. The potential preview

The "potential" image is a synthetic picture generated by an AI image model from your own photo. It is an illustration of a possible direction, not a prediction, projection or promise.

It does not represent a result you will achieve, a result that is achievable for you, or a result that following the routine will produce. It is not a medical or cosmetic simulation, and it must not be used to set expectations for any medical, dental, dermatological or surgical procedure. The generated image may differ from you in ways the model did not intend.

The accompanying "potential score" is a derived figure calculated by the app, not a target we commit to.

7. Not medical or professional advice

Nothing in the Service — no score, rationale, routine task, Coach reply or note about your skin, jaw, eyes or cheekbones — is medical, dermatological, dental, nutritional, orthodontic, psychological or any other form of professional advice, diagnosis or treatment. Facely does not detect, diagnose, screen for, treat, prevent or monitor any disease or condition, including skin cancer or any other skin condition.

Always consult a qualified healthcare professional about any concern regarding your skin, health or appearance, and before starting any new skincare product, supplement, diet, exercise or treatment. Never disregard or delay professional medical advice because of something you read in Facely. If you notice a mole, lesion or skin change that concerns you, see a doctor — Facely cannot assess it and will not warn you about it.

In an emergency, contact your local emergency services.

8. Wellbeing

Facely is built to be honest with you, which means it can return a number lower than you hoped. If you have, or think you may have, body dysmorphic disorder, an eating disorder, or any condition that makes appearance-related feedback distressing, please consider whether this app is right for you, and speak to a qualified professional.

A score is not a verdict on you. If using Facely is making you feel worse rather than motivated, the right decision is to stop using it and delete your account. If you are in distress or having thoughts of harming yourself, please contact your local crisis line or emergency services immediately.

9. Your content and the rights you grant

"Your Content" means the photographs, profile answers, messages and feedback you submit.

You keep ownership of Your Content. We claim no ownership in your photographs.

You grant us a limited, worldwide, royalty-free licence to host, store, reproduce, transmit, modify (for example, to resize a photo) and process Your Content solely to operate the Service for you — including sending it to the AI providers named in our Privacy Policy. This licence exists only to run the features you use, ends when you delete the relevant content or your account, and grants us no right to publish, display, market or sell Your Content. We do not use your photographs to train AI models.

By submitting a photograph you represent and warrant that:

• it is a photograph of yourself;
• you took it or otherwise hold all necessary rights to it;
• no other identifiable person appears in it without their informed consent, and no one depicted is a minor other than yourself; and
• it contains no nudity, sexual content, violent or illegal content, and infringes no one's rights.

Uploading someone else's face — a friend, a celebrity, a stranger, or an image found online — is a breach of these Terms and may also break the law where you live.

10. Acceptable use

You agree not to:

• use the Service for any unlawful purpose, or to harass, bully, demean or rank other people;
• submit photographs of anyone other than yourself;
• present Facely scores as an objective or authoritative assessment of another person;
• reverse engineer, decompile, disassemble or attempt to extract the source code, prompts, models or scoring logic of the Service, except to the extent this restriction is prohibited by law;
• access the Service by any automated means, or build any bot, script or scraper against it;
• circumvent, or attempt to circumvent, scan limits, subscription gating, rate limits or any other technical restriction, including by creating multiple accounts;
• interfere with, overload or disrupt the Service or its infrastructure, or probe it for vulnerabilities without our written permission;
• attempt to make the AI Coach produce content outside its intended purpose, or to elicit our prompts or system instructions;
• resell, sublicense, or commercially exploit the Service or its output, or use it to build a competing product; or
• remove, obscure or alter any Facely branding, including on score cards you share.

We may suspend or terminate access for any breach of this section.

11. Scan limits and fair use

Scanning is expensive to provide, so it is capped at five scans per rolling 24-hour period per account. This limit is enforced by our servers and may be changed at any time. Attempting to work around it, including by repeatedly creating new accounts, is a breach of section 10.

The limit is also deliberate product design: skin changes over weeks and bone structure does not change at all, so additional same-day scans measure lighting and camera angle rather than progress.

12. Subscriptions, trials and billing

Some features may require a paid subscription. Where they do, the following applies.

• Billing is handled by Apple. Payment is charged to your Apple Account at confirmation of purchase. We never see or store your payment card details.
• The paywall is presented by Superwall. We use Superwall to display the subscription screen, to record how you interact with it, and to tell the app whether your subscription is active. The purchase itself is still made through Apple. What Superwall receives is described in the Privacy Policy.
• Subscriptions renew automatically. Your subscription renews at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the period.
• Free trials. Where a free trial is offered, it converts into a paid subscription automatically at the end of the trial unless you cancel at least 24 hours before it ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Cancelling. Manage or cancel your subscription in your device's Settings → your name → Subscriptions. Deleting the Facely app does not cancel a subscription. Cancelling stops future renewals; it does not refund the current period, and you keep access until the period ends.
• Refunds. Purchases are handled by Apple and refund requests are subject to Apple's policies. We cannot issue refunds for App Store purchases directly. Statutory rights of withdrawal or refund that apply where you live are unaffected.
• Price and plan changes. We may change prices and what each plan includes. Changes to a recurring price take effect on the next renewal after we give notice, and Apple will ask for your consent where required.

13. Intellectual property

The Service — including the app, its design, the Facely name and wordmark, the scoring rubric, the routine library, our prompts and all associated content — is owned by us or our licensors and is protected by intellectual property law. These Terms grant you no right to use our trademarks or branding except as they appear in score cards the app itself generates for you to share.

Subject to these Terms, you may use the results and generated images the app produces for you for your own personal, non-commercial purposes, including sharing them on social media.

14. Feedback

If you send us suggestions or ideas about the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free right to use them for any purpose without obligation or compensation to you. Please do not send us confidential information.

15. Third-party services

The Service depends on third parties, including Google (AI processing), Supabase (hosting), Superwall (subscription paywalls) and Apple (distribution and payments). Their availability, terms and policies are outside our control, and an interruption at any of them may interrupt the Service. Links from the app to third-party websites are provided for convenience and we are not responsible for their content.

16. Availability and changes

We provide the Service on an "as available" basis and may modify, suspend, limit or discontinue any feature at any time, with or without notice. We may also update these Terms. If a change is material we will give notice in the app before it takes effect; continuing to use the Service after that means you accept the updated Terms. If you do not accept them, stop using the Service and delete your account.

17. Termination

You may terminate at any time by deleting your account in the app and removing it from your device. We may suspend or terminate your access immediately, without notice, if you breach these Terms, if we suspect fraud or abuse, or if we are required to by law or discontinue the Service.

Sections 9 (as to rights already granted), 13, 14, 18, 19, 20, 21 and 23 survive termination.

18. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, or arising from a course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, secure or error-free; that scores, rationales, routines, Coach replies or generated images will be accurate, reliable, consistent or complete; or that using the Service will improve your appearance, your score, your confidence or any other outcome. We make no representation that any result depicted or suggested is achievable.

Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you. Nothing in these Terms limits any statutory consumer right you cannot lawfully waive.

19. Limitation of liability

To the maximum extent permitted by law, neither Facely nor its officers, employees, contractors or suppliers will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or emotional distress, arising out of or relating to your use of, or inability to use, the Service — whether based in contract, tort, negligence, strict liability or otherwise, and even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 50.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

20. Indemnification

You agree to indemnify and hold harmless Facely and its officers, employees, contractors and suppliers from any claim, demand, loss, liability or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Service, or your submission of content you had no right to submit — in particular, photographs of another person.

21. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict of law rules. You and we agree to the exclusive jurisdiction of the courts of the Province of Ontario for any dispute not otherwise resolved.

If you are a consumer, nothing here deprives you of the protection of the mandatory consumer-protection laws of the place where you live, including, in Ontario, the Consumer Protection Act, 2002. If you are a consumer resident in the EEA or the UK, nothing here deprives you of the protection of the mandatory laws of your country of residence, or of your right to bring proceedings in your local courts.

22. Apple App Store terms

This section applies to the app obtained through the Apple App Store.

• These Terms are between you and Facely only, not with Apple. Facely, not Apple, is solely responsible for the app and its content.
• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Facely, not Apple, is responsible for addressing any claim relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• Facely, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that the app infringes intellectual property rights.
• You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

23. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
